Consent & Release
I enter into this agreement (the “Agreement”) with REBECCA ROSEN ENTERPRISES, INC. (“Company”), to confirm in this Agreement the conditions of my participation in the reading to be performed by Rebecca Rosen (“Rosen”).
I acknowledge that I have voluntarily agreed to participate and request Rosen to perform this reading. I am aware that my participation in this reading is not a substitute for psychiatric treatment, psychotherapy, therapeutic counseling or any other form of professional therapy. I am voluntarily participating in this reading and I accept complete responsibility for my own psychological, mental, emotional and spiritual well-being. I acknowledge that it is my responsibility to ascertain my own need for professional counseling and to seek such professional counseling, as needed, and statements made by Rosen should not be used in place of any professional, medical, financial, or legal counselling I would ordinarily seek for professional advice.
I understand and agree that neither Company nor Rosen is responsible for decisions I may make based on the advice or information obtained from or in connection with the reading performed by Rosen, and that neither Company nor Rosen is responsible for the choices or decisions I make by visiting any website or location of Company or Rosen or using any of the services offered by Company and/or Rosen in regards to my finances, medical care, legal circumstances, career, or personal or professional life in any way.
I understand and agree that Company and Rosen make no representations or warranties, express or implied, with respect to the accuracy, relevancy, or quality of the information conveyed by Rosen, and do not assume and hereby disclaim any liability to any person or entity for any loss or damages (including, without limitation, physical, mental, special, indirect, incidental or consequential) caused in regard to any information and/or any suggestions or advice provided to me by Rosen, or as a result of my use of Rosen’s services, regardless of whether resulting from negligence, accident, or any other cause whatsoever.
For and in consideration of my voluntary participation in this reading, I, on behalf of myself and my assigns, heirs, executors, guardians and other legal representatives, release, discharge, waive and forever relinquish Company and Rosen (including Company’s and Rosen's agents, employees, officers and directors) from any and all claims, known or unknown, arising out of or in any way connected with my participation or involvement in this reading including, but not limited to, any information provided to me or statements made during such reading. Further, I, on behalf of myself and my assigns, heirs, executors, guardians and other legal representatives, release, discharge, waive and forever relinquish any actions or causes of action whatsoever which may later arise, and I agree that under no circumstances will I or my assigns, heirs, executors, guardians and other legal representatives, prosecute or present any claims against, sue, or seek to attach the property of Company and/or Rosen (including Company’s or Rosen's agents, employees, officers or directors), and that I waive all actions, claims or demands that I now or hereafter may have, for any injuries suffered by me during my participation or involvement in the reading, resulting from any acts or omissions of Company, Rosen, or any agent, employee, officer or director of Company and/or Rosen, or resulting from the acts or omissions of any other participant in the reading.
I, for myself and my assigns, heirs, executors, guardians and other legal representatives, hereby agree that in the event any claim for damages shall be prosecuted against Company or Rosen (or Company’s or Rosen's agents, employees, officers or directors) as a result of my acts or omissions, that I, or my estate, shall indemnify and save harmless Company and Rosen (including Company’s and Rosen's agents, employees, officers or directors), from any and all claims or causes of action by whomever and wherever made or presented for damages, including the cost and expense of defending the same.
To the extent that any lawsuit, claim or other formal proceeding arises out of or in relation to this agreement, the prevailing party shall be entitled to reasonable attorneys’ fees and costs.
I further acknowledge and understand that any information provided during this reading or any other statements made during same shall be considered confidential and shall not be disclosed except as required by law.
I understand and agree that this Agreement shall be governed by the laws of the State of Colorado, and its validity, constructions, interpretation and legal effect shall be governed by the laws of the State of Colorado applicable to contracts entered into and performed entirely within the State of Colorado. Further, I agree to that the venue for any action, suit or proceeding arising from or based upon this Agreement shall be the appropriate State and Federal Courts located the County of Denver in the State of Colorado. In connection with the foregoing, I agree to submit to and be bound by the jurisdiction of the appropriate State and Federal Courts located in the County of Denver in the State of Colorado.
I have carefully read this Agreement and fully understand its contents, terms and significance and understand the legal consequences of signing this Agreement. I am aware that this Agreement contains a release of liability and a contract between myself and Company and I sign this Agreement of my own free will.
